Atul Subhash suicide case: Family of Bengaluru techie opposes Nikita Singhania’s bail, seeks custody of child

The family of Atul Subhash, a Bengaluru techie who died by suicide on December 9, has strongly opposed the bail plea of his wife, Nikita Singhania, alleging her involvement in his harassment and abetment to suicide over a Rs.3 crore divorce settlement demand. The family is also seeking custody of the couple’s 4-year-old child, citing safety concerns.

Bail plea hearing and legal arguments

The bail plea for Nikita Singhania is scheduled to be heard on January 4 in the Bengaluru court. Her counsel filed the application on Monday, arguing against the allegations, while the counsel for Atul Subhash’s family opposed granting bail.

Akash Jindal, the family’s counsel, stated, “The criminal nature of the case is serious, and she cannot take advantage of the child to secure bail. We have sought total custody of the child and filed a habeas corpus petition in the Supreme Court to ascertain his whereabouts.”

The Supreme Court has directed authorities in Uttar Pradesh, Karnataka, and Haryana to locate the missing child, who was reportedly staying in a hostel before disappearing.

Family’s concerns for the child

Atul’s father, Pavan Kumar Modi, expressed deep concerns over the child’s safety, fearing potential harm if custody is granted to Nikita. “If she can drive my son to commit suicide, she could harm the child as well,” he said. Modi accused Nikita of treating the child as a source of financial gain, alleging repeated demands for increased maintenance payments, which escalated from Rs.20,000 to Rs.80,000 and beyond.

Bikas Kumar, Atul’s brother, emphasized the importance of gaining custody of the child. “We have informed our advocate and are awaiting the Supreme Court hearing on January 7. The child’s safety is our priority,” he said.

Subhash’s suicide and allegations

Atul Subhash, an automobile company employee, died by suicide in his apartment on December 9, leaving behind a 90-minute video and a 40-page note detailing harassment by his wife and her family. He alleged that false cases were filed against him and that he was taunted in court with an ultimatum to either pay Rs.3 crore or take his own life.

In response to Atul’s allegations, Nikita’s family claimed that Atul had demanded a hefty dowry, which they say contributed to her father’s death.

Police investigation

Nikita Singhania, her mother Nisha Singhania, and her brother Anurag Singhania were arrested by Bengaluru Police and are currently in 14-day judicial custody. An FIR was registered under Sections 108 and 3(5) of the Bharatiya Nyay Sanhita (BNS) following a complaint by Bikas Kumar, accusing them of abetment to suicide.

The police are continuing their investigation, with Bikas Kumar commending their efforts. “The police have supported us and are carrying out the investigation diligently,” he said.
