An influential Republican lawmaker, Congressman Lance Gooden, has challenged the Biden administration’s decision to investigate Indian billionaire Gautam Adani and his companies. In a letter addressed to US Attorney General Merrick B Garland, dated January 7, Gooden criticized the Justice Department’s (DOJ) actions, stating that such selective investigations could damage the United States’ critical alliances, particularly with India.

Concerns over selective investigations

Gooden, a member of the House Judiciary Committee, expressed concerns over what he called “selective prosecution of foreign entities” and questioned the relevance of the investigation to US interests. He also raised questions about any potential connections to George Soros in the matter.

“The Department of Justice’s selective actions risk damaging critical alliances with key partners like India, one of America’s strongest allies in the Asia-Pacific region,” Gooden wrote. He urged the DOJ to focus on domestic issues, such as violent crime and economic espionage, rather than pursuing cases with tenuous jurisdiction abroad.

Gooden emphasized that targeting entities like Adani Group, which invest billions of dollars and create thousands of American jobs, could harm the US economy in the long run.

“When we forego real threats from violent crime, economic espionage, and CCP influence and go after those who contribute to our economic growth, it discourages valuable new investors,” he stated. Gooden also warned that a politically charged atmosphere for investors could undermine efforts to revitalize the US economy, a key priority for President Trump’s incoming administration.

Gooden questioned the timing of the DOJ’s actions, coinciding with the end of the Biden administration and the imminent inauguration of Donald Trump as the 47th president on January 20. He speculated that the investigation might be politically motivated to disrupt Trump’s administration.

“Instead of expending taxpayer resources on politically motivated pursuits in foreign countries, the DOJ should cooperate with the incoming administration to better serve the American people,” he added.

Gooden pointed out that the allegations in the Adani case primarily involve Indian entities and activities within India, with no direct American involvement or injury.

“These ‘bribes’ were allegedly paid to Indian state government officials, in India, by Indian executives of an Indian company, with no concrete involvement of or injury to any American party,” he wrote.

He also contrasted the DOJ’s actions against Adani with its handling of cases like Smartmatic, an American company allegedly involved in laundering money and bribing foreign governments. Gooden questioned why the DOJ has not indicted any Americans if the Adani case involves a significant nexus with the United States.

Gooden expressed concern over the potential escalation of the case into an international incident with India, a key US ally. He raised questions about the DOJ’s contingency plans if India refuses to comply with extradition requests and claims sole authority over the case.

“Is the DOJ or the Biden administration willing to escalate this case into an international incident with an ally like India?” he asked.

Gooden urged the DOJ to reconsider its approach to international cases, particularly those with limited relevance to US interests, to avoid straining critical alliances and discouraging foreign investment. His letter reflects broader Republican concerns about the Biden administration’s actions as the US transitions to the Trump presidency.
