In a significant development ahead of the Delhi elections, the Union Home Ministry has granted permission to the Enforcement Directorate (ED) to prosecute Aam Aadmi Party (AAP) leader and former Chief Minister Arvind Kejriwal in a money laundering case tied to the now-scrapped Delhi liquor policy. The clearance also extends to prosecuting senior AAP leader and former Deputy Chief Minister Manish Sisodia.

SC ruling opens the path for prosecution

The approval comes months after a Supreme Court ruling in November, which mandated that the ED, like the Central Bureau of Investigation (CBI), must secure prior sanction to prosecute public servants. The ED has accused Kejriwal of masterminding alleged irregularities in the Delhi liquor policy case, but the framing of charges had been stalled due to the lack of clearance. With the Home Ministry’s nod, this legal hurdle has been removed.

Legal challenges by AAP leaders

Kejriwal had previously challenged the trial court’s decision to take note of the chargesheet against him, arguing that the ED lacked the necessary sanction. Both Kejriwal and Sisodia were arrested in connection with money laundering allegations linked to the liquor policy but are currently out on bail. The two leaders have denied all charges, accusing the BJP of using central agencies to target political opponents.

Election campaigns amid legal troubles

Despite the legal challenges, Kejriwal and Sisodia are actively campaigning for the Delhi elections scheduled for February 5. Kejriwal announced plans to file his nomination to contest from the New Delhi constituency.

The ED’s fresh clearance is expected to escalate political tensions, with the BJP likely intensifying its attacks on the AAP as the elections approach.
