SC questions Assam on delay; demands immediate deportation

The Supreme Court strongly criticized the Assam government for its failure to deport individuals declared as foreigners, questioning whether the state was waiting for an auspicious time (“muhurat“) to act.

A bench comprising Justice Abhay S Oka and Justice Ujjal Bhuyan ordered Assam to deport 63 individuals currently held in detention centers after they were classified as foreigners during the National Register of Citizens (NRC) update exercise.

Assam’s response fails to convince SC

• The Assam government argued that it was unable to deport the individuals as their addresses in their home countries were unknown.
• The court dismissed this argument, stating that foreigners could be deported to the capital city of their respective countries.
• Justice Oka accused Assam of suppressing facts, adding, “We will issue a perjury notice to you. You are supposed to come clean.”

SC questions delay in deportation

• Justice Bhuyan questioned the Assam government on the next logical step after declaring someone a foreigner.
• He emphasized that indefinite detention was a violation of Article 21 and asked, “How many detainees have been deported so far?”
• Justice Oka rebuked the state for not involving the Ministry of External Affairs, asking, “Why have you not submitted a proposal seeking assistance?”

SC orders immediate action

The bench made it clear that foreigners must be deported immediately, stating:

• “Once their status is known, why wait for their address?“
• “It is for the other country to decide where they should be placed, not for Assam to detain them indefinitely.“

The court’s strong remarks reflect its growing impatience with Assam’s handling of declared foreigners, pushing the government to act decisively and coordinate with external affairs authorities for immediate deportation.
