Dr.Swamy criticizes AIS marriage transfer rule, cites violation of Article 14

BJP leader Subramanian Swamy urged the government to bring parity in inter-cadre transfer rules on marriage for all government staff. In a detailed letter to Jitendra Singh, Minister of State for Personnel & Training, Swamy said that the current inter-cadre change due to marriage must apply to all employees and limiting only to All India Service officers is a violation of Article 14 of the Constitution.

Article 14 of the Constitution of India assures equality. Swamy pointed out that latest Office Memorandum of 2022, the inter-cadre changes due to marriage guidelines only allow cadre change to All India Service Officers. “According to the aforementioned OM (Office Memorandum), inter-cadre transfers are permitted for All India Service officers who marry another All India Service Officer, provided the officer or officers concerned have requested the change. However, inter-cadre transfers are not permitted for All India Service officers who marry an officer serving in a Central Service/ State Service/ Public Sector Undertaking/ any other organization.

“It is important to highlight that there is no rationale behind imposing a condition that inter-cadre transfer shall not be permitted to All India Service officer on account of marriage to an officer serving in any other State Service/ Central Service/ PSU/ any other organization,” said Swamy in letter DoPT Minister Jitendra Singh.

“At this juncture, I would like to reiterate that Article 14 enshrines the principle that the State ought not to deny any person “equality before the law”. I would also like to emphasize that, in certain situations where two officers are deputed in two different states, it becomes extremely difficult and time-consuming for them to meet,” pointed out Swamy, urging for relaxation of rules.

“These lacunas adversely affect not only the lifestyle of the married individuals but, in certain situations, also the lifestyle and upbringing of their children,” added Subramanian Swamy.
